These Terms and Conditions (“Terms”) govern your access to and use of the Cybermitra.ai website, mobile application, Interactive Voice Response (IVR) system, and related services (collectively, the “Service”) provided by [Your Company Name] (“Cybermitra.ai,” “we,” “us,” or “our”).

1. Description of Service

Cybermitra.ai provides an AI-powered platform designed to assist users (“Users,” “you,” “your”) in India who have been victims of digital financial fraud. The Service aims to:

  • Facilitate the gathering of relevant information about the fraud incident through interfaces like our IVR system (available in multiple languages) and potentially a mobile application.
  • Utilize AI and automated processes to analyze the information provided, potentially identify key data points (like UTR numbers), and structure this information.
  • Assist users in compiling and understanding the necessary details required for reporting the fraud to relevant third parties (such as banks, payment gateways, or law enforcement portals like the National Cyber Crime Reporting Portal – NCRP).
  • Provide guidance and information related to the fraud reporting and potential recovery process.

Important Limitations:

  • Cybermitra.ai is an assistance tool, not a recovery agency, financial institution, law enforcement agency, or legal firm.
  • We DO NOT guarantee the recovery of any funds. The success of any recovery attempt depends on numerous factors outside our control, including the actions of banks, law enforcement, the specifics of the fraud, and the timeliness of reporting.
  • The Service does not constitute legal advice or financial advice.

2. Eligibility

To use the Service, you must:

  • Be a resident of India.
  • Be at least 18 years old.
  • Have the legal capacity to enter into binding contracts.
  • Agree to these Terms and our Privacy Policy.

3. User Accounts (If Applicable)

If using features that require an account (e.g., mobile application):

  • You agree to provide accurate, current, and complete information during the registration process and keep it updated.
  • You are responsible for safeguarding your account credentials and for all activities that occur under your account.
  • You agree to notify us immediately of any unauthorized use of your account.   

4. User Responsibilities   

By using the Service, you agree to:

  • Provide truthful, accurate, and complete information regarding the fraud incident and any other requested details. The effectiveness of the Service heavily relies on the accuracy of the information you provide.
  • Cooperate with the information gathering process.
  • Carefully review any information compiled or reports generated by the Service before submitting them to any third party. You are solely responsible for the final accuracy and submission of any complaint or report.
  • Use the Service only for its intended purpose (assistance with digital financial fraud reporting and guidance) and in compliance with all applicable Indian laws and regulations.
  • Not use the Service to report false incidents, harass others, or engage in any illegal or fraudulent activity.
  • Grant Cybermitra.ai the necessary permissions to process the data you provide (including personal and potentially sensitive financial data) using AI and automated systems for the purpose of providing the Service, as outlined in our Privacy Policy.

5. Data Privacy

Your privacy is important to us. Our collection, use, storage, and protection of your personal data are governed by our Privacy Policy [Link to Privacy Policy], which is incorporated by reference into these Terms. Please review it carefully. We implement reasonable security measures, but cannot guarantee absolute security.

6. Use of AI and Automation

You acknowledge that the Service utilizes Artificial Intelligence (AI) and automated systems. While we strive for accuracy, AI systems rely on data patterns and may have limitations or make errors. Any outputs, suggestions, or compiled information provided by the AI should be reviewed by you for accuracy before taking any action or submitting reports.

7. No Guarantee of Recovery or Outcome

Cybermitra.ai makes no representations, warranties, or guarantees, express or implied, regarding the likelihood of success in recovering funds lost to fraud. Our role is limited to assisting you in organizing information and facilitating the reporting process.

8. No Legal or Financial Advice

The information and guidance provided through the Service are for informational purposes only and do not constitute legal, financial, or investment advice. You should consult with qualified legal or financial professionals for advice tailored to your specific situation.

9. Interaction with Third Parties

The Service may assist you in preparing information to be submitted to third parties (e.g., banks, NCRP). Cybermitra.ai does not act as your legal representative. Any interaction or submission you make to these third parties is your own responsibility, even if facilitated by our Service using the information you provided and authorized.

10. Intellectual Property

All rights, title, and interest in and to the Service, including the website, application, IVR system, AI models, underlying technology, content (excluding user-provided data), and branding, are and will remain the exclusive property of Cybermitra.ai and its licensors. You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit these restrictions or you have our written permission.   

11. Fees and Payment

Currently, basic access to our fraud reporting assistance via the IVR and application may be offered at no upfront cost to victims. However, Cybermitra.ai reserves the right to introduce fees for certain premium features, enhanced services, success-based outcomes (e.g., a percentage of recovered funds), or related products like fraud insurance in the future. Any such fees will be clearly communicated, and you will have the opportunity to agree to them before incurring charges. Separate terms and conditions may apply to paid services.

12. Disclaimers of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION YOU PROVIDE WILL BE SECURE.   

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CYBERMITRA.AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (c) ANY CONTENT OBTAINED FROM THE SERVICE; (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (e) THE FAILURE TO RECOVER ANY FUNDS OR ANY NEGATIVE OUTCOME RELATED TO YOUR FRAUD CASE.   

IN NO EVENT SHALL CYBERMITRA.AI’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE THOUSAND INDIAN RUPEES (INR 1000) OR THE AMOUNT YOU PAID CYBERMITRA.AI, IF ANY, IN THE LAST 12 MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless Cybermitra.ai and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your provided information caused damage to a third party.   

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your use of the Service at any time. Provisions that by their nature should survive termination shall survive (including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability).   

16. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.   

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Noida, Uttar Pradesh, India. The language of the arbitration shall be English.   

Notwithstanding the foregoing, you agree that we shall be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction. Subject to the arbitration clause, the courts located in Noida, Uttar Pradesh, India shall have exclusive jurisdiction over any disputes arising from or related to these Terms or the Service.   

17. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect (e.g., via email or a notification through the Service). What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.   

18. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.   

19. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Cybermitra.ai regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
