1. Agreement to Terms
This document constitutes a legally binding agreement ("Agreement") between you ("user," "you," or "your") and CyberMitra Technologies Private Limited ("we," "us," or "our"), governing your use of the CyberMitra.ai website and its associated fraud prevention services (collectively, the "Service").
By creating an account, or by accessing or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these terms, you may not use the Service.
2. Description of Service
CyberMitra.ai provides a software-as-a-service (SaaS) platform designed to enhance your personal and business security by analyzing communications data (such as emails, personal messages, and call metadata) to detect and flag potential scams, phishing attempts, and other fraudulent activities.
3. Data Privacy and Security: Your Acknowledgement
Our Service's ability to protect you depends on its ability to analyze your data for threats. We understand this is a significant responsibility, and we have engineered our system around a principle of "Security First."

• Limited Purpose: You grant us a limited, revocable license to access and process your communications content for the sole and exclusive purpose of detecting and preventing fraudulent activity. Your data will not be used for advertising, sold to third parties, or used for any other commercial purpose.
• Our Security Approach: We employ a multi-step approach to data security.
• On-Device Processing: To minimize data transmission, a significant portion of the analysis is offloaded to your local device ("on the edge").
• Anonymization & Encryption: In cases where data must be sent to our servers for more complex analysis, it is first anonymized to remove personally identifiable information (PII) and is protected with end-to-end encryption both in transit and at rest.
• Your Consent: By using the Service, you explicitly consent to this processing of your data as described above and in our Privacy Policy. You acknowledge that this processing is essential for the Service to function.

4. User Accounts and Responsibilities

• Account Creation: You must provide accurate, current, and complete information during the registration process.
• Security: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.
• Lawful Use: You agree to use the Service only for lawful purposes and in accordance with these Terms.

5. Subscriptions, Billing, and Cancellation
Our subscription and billing policies are governed by our Refund & Cancellation Policy.

• Annual Billing: All subscription plans are billed annually in advance.
• Non-Refundable: All payments are non-refundable. We do not provide refunds or credits for any partial subscription periods.
• Cancellation: You may cancel your subscription at any time. Upon cancellation, your access to the Service will continue until the end of your prepaid annual term.
• Third-Party Cyber Insurance: Certain subscription plans may include a cyber insurance add-on. You acknowledge that this insurance is provided and underwritten by one of our third-party insurance partners, not directly by CyberMitra Technologies Private Limited. Your coverage is subject to the terms, conditions, and exclusions of the policy issued by the respective insurance provider. We act solely as a facilitator for this benefit.

6. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of CyberMitra Technologies Private Limited and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
7. Disclaimer of Warranties and Limitation of Liability
This section is crucial for you to understand the limitations of the Service.

• "As Is" Service: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
• No Guarantee of Prevention: Cyber fraud is a constantly and rapidly evolving landscape. While our mission is to protect our users and we are committed to continuously updating our threat detection models, we do not guarantee that the Service will detect or prevent all fraudulent or malicious activities.
• Service as a Security Layer: You acknowledge that the Service is an enhanced security layer, not an infallible shield. It is not a replacement for your own vigilance, sound judgment, and good security practices.
• Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall CyberMitra Technologies Private Limited, its directors, employees, or affiliates be liable for any financial loss, data breach, or any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the Service, including any damages resulting from a security incident or fraudulent activity that was not detected by the Service. Our total liability to you for any and all claims arising from the use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

8. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Noida, Uttar Pradesh, India to resolve any legal matter arising from the Terms.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect.
